What is mediation?
Mediation is a process in which a third-party neutral, whether one mediator or more, acts as a facilitator to assist in resolving a dispute between two or more parties. Mediators do not make judgments, express opinions or give legal advice.
Mediation aims for win-win solutions and is conducted in a neutral setting where parties retain control over the outcome and are therefore more willing to follow the agreements. The immediate goal of mediation is to resolve the dispute at hand, and the process seeks to mend relationships that continue in the future.
Mediation is based on the voluntary cooperation and good faith participation of all parties. Although participation in some mediation programs may be mandatory, reaching agreement is always voluntary.
